This Terms and Conditions document (“Agreement”) governs your use of the Website and any services, tools, and features offered by Shopearnhub. By accessing or using the Website, you agree to be legally bound by these Terms and Conditions, our Privacy Policy, and any other policies or guidelines that may be posted on the Website from time to time. If you do not agree with any of these terms, you are advised not to use the Website.

2. Legal Basis

This Agreement is governed by the laws of India and complies with the following legislation:

  • Information Technology Act, 2000 and the rules framed thereunder;
  • Consumer Protection (E-Commerce) Rules, 2020;
  • Indian Contract Act, 1872;
  • Digital Personal Data Protection Act, 2023;
  • and other relevant laws and regulations applicable in India.

Unauthorized access, distribution, reproduction, copying, retransmission, publication, sale, exploitation (commercial or otherwise), or any other form of transfer of any portion of the Site, Application or Services, including but not limited to all content, services, digital products, tools or products, is hereby expressly prohibited

3. Nature of Services

Shopearnhub provides users with:

  • Access to affiliate marketing deals and promotional coupons;
  • Links to third-party e-commerce platforms;
  • Cashback on qualifying purchases completed through affiliate links.

Shopearnhub acts solely as an intermediary between the user and the third-party merchant and does not hold any responsibility for the products or services offered by those merchants.

4. Cashback Program Terms

4.1 Cashback Eligibility:

  • Cashback is credited only for eligible purchases made through affiliate links hosted on Shopearnhub.
  • The transaction must be completed within the same session after clicking the affiliate link.
  • The merchant must confirm the purchase and pay Shopearnhub the affiliate commission.

4.2 Processing Time:

  • Cashback validation depends on the return period and policy of the affiliate merchant and may take between 30 to 90 days.

4.3 Exclusions:

  • Orders returned, cancelled, or altered may lead to cashback rejection.
  • Cashback is not applicable if tracking is disrupted due to ad blockers or other reasons.

4.4 Payment of Cashback:

  • Users must provide accurate payment details (bank account, UPI ID, or wallet) to receive cashback.
  • We are not liable for cashback payment failures due to incorrect or incomplete information.

4.5 Minimum Withdrawal Threshold:

  • A minimum cashback amount may be required to request a withdrawal ( INR 100).

5. User Registration and Account Security

5.1 Registration Requirements:

  • Users must register using valid information including mobile number, email address, and social media profile (where applicable).
  • Shopearnhub reserves the right to verify the user identity through OTP or other means.

5.2 Account Security:

  • Users are responsible for maintaining the confidentiality of their login credentials.
  • Any activity under a user’s account is deemed to be authorized by the user.

6. Data Collection and Usage

6.1 Collected Data:
We collect the following personal data:

  • Name, mobile number, email ID;
  • Social profile (for login);
  • Transaction and purchase history;
  • Payment information (e.g., UPI ID, bank account details).

6.2 Use of Data:

  • To create and manage user accounts;
  • To track affiliate transactions;
  • To process and disburse cashback;
  • To improve service offerings;
  • To comply with legal obligations.

6.3 Data Protection:
We implement reasonable security measures in compliance with the Digital Personal Data Protection Act, 2023 to protect your personal data from unauthorized access, disclosure, or misuse.

7. User Obligations

Users agree:

  • To use the Website only for lawful purposes;
  • Not to misuse the cashback system or create fraudulent accounts;
  • Not to copy, reproduce, or distribute any content or intellectual property from the Website without authorization;
  • To comply with all applicable laws and third-party terms.

8. Intellectual Property Rights

All trademarks, logos, software, design, and content displayed on Shopearnhub are the property of EdibleShope or its licensors and are protected under The Copyright Act, 1957 and The Trademarks Act, 1999. Unauthorized use may lead to legal consequences.

9. Third-Party Relationships

Shopearnhub includes links to third-party e-commerce platforms. We:

  • Do not sell or guarantee any product or service;
  • Are not responsible for delivery, returns, or warranty claims;
  • Will not be liable for any disputes arising between the user and the third-party merchant.

Users are advised to carefully read and accept the third-party merchant’s terms before completing a purchase.

10. Limitation of Liability

To the fullest extent permissible under Indian law, EdibleShope and Shopearnhub shall not be liable for:

  • Loss of cashback due to affiliate partner rejection;
  • Errors caused by user negligence, including providing incorrect information;
  • Service interruptions due to server or third-party outages;
  • Indirect or consequential damages of any kind.

11. Termination of Account

We may suspend or terminate a user account without notice if:

  • There is suspicion of fraudulent or abusive behaviour;
  • The user violates any term of this Agreement;
  • The account is inactive for an extended period.

Users may also request account deletion by contacting support.

12. Tax Compliance

Cashback payments may be treated as income and are subject to taxation as per Indian tax laws. Users are responsible for declaring such income in their tax filings. We may issue TDS certificates or withhold taxes if required by law.
